Registering as a user, viewing and/or ordering and purchasing the products presented on the website https://www.indiamart.ro implies tacit and unreserved acceptance of the terms and conditions of use, detailed below.

We reserve the right to modify the Terms and Conditions of Use, as well as the presentation and structuring of the website https://www.indiamart.ro at any time without prior notice to users. In this regard, for good information, please visit this section periodically.

The entire content of the site https://www.indiamart.ro , including but not limited to, graphics, logos, buttons, programs, multimedia content, web graphics elements, scripts and any other data, is the property of SC IndiaMart SRL and/or its suppliers presented on the aforementioned site and is protected by Law no. 8/1996 on copyright and related rights, with subsequent amendments and completions, Law no. 84/1998 on trademarks and geographical indications, with subsequent amendments and completions, Law no. 129/1992 on industrial models and designs, republished, as well as by any other legal provisions in this regard.

The use without prior written consent, regardless of purpose, of any elements on the website https://www.indiamart.ro is punishable according to the laws in force.

Attempting or performing unauthorized operations on this site, namely abusive use, fraudulent use, unauthorized access, modification and/or copying of information for the purpose of selling it or any other such actions contrary to the interests of IndiaMart SRL, will be punished according to the law.

Limitations of liability

SC IndiaMart SRL assumes no responsibility and is not liable for any damages arising from the use in any way of the products purchased through this site. SC IndiaMart SRL does not guarantee and cannot be held responsible if the purchased products do not correspond to the purpose for which they were purchased.

SC IndiaMart SRL verifies the accuracy of any information on the Site, but is not responsible for the content and availability of the Site.

SC IndiaMart SRL is exempt from liability and has no contractual obligation in the following situations:

• product photos (static, dynamic, presentations) are used exclusively for presentation purposes and may contain accessories not included in the standard package, and there may be differences between the actual color of the products and that displayed on the monitor used, depending on its settings;

• some technical specifications, product descriptions or prices may be modified without notice by the supplier and/or manufacturer or may contain operating errors; confirmation of the final price will be made by IndiaMart SRL representatives, electronically or by telephone, after receiving the order in electronic form;

• the availability in stock of all products presented, this depends on the product suppliers and manufacturers; confirmation of availability and delivery time for the requested product will be made by representatives of IndiaMart SRL, electronically or by telephone, after receiving the order in electronic form;

• product defects and their repair are the responsibility of the supplier/manufacturer; the maximum amount of damages that can be paid by IndiaMart SRL, in the event of non-delivery or improper delivery – and declared according to the specifications below – is the amount collected from the customer;

• non-delivery of ordered products, delayed delivery or improper delivery thereof, in cases of force majeure: fires, explosions, floods, epidemics, strikes, government actions, wars, acts of terrorism, protests, riots, civil unrest or other force majeure impediments, according to the provisions of applicable Romanian legislation in force at the time of order confirmation;

• withdrawal of product offers;

• accessing external sites that contain links to this site, this being done exclusively at your own risk;

• unconfirmed order, which does not have the value of a contract;

• additional costs incurred by the customer at the time of payment, other than those confirmed by IndiaMart SRL - shipping price, etc. and which are the responsibility of the customer and/or his bank;

• IndiaMart SRL guarantees the security and confidentiality of data hosted and transmitted through its computer system, but does not assume responsibility for any loss of information caused by any malfunctions or errors in the software with which the site is designed and hosted.

Users expressly agree that use of this site and purchase of products or services is at their own risk.

Personal data

The user's personal data may be used with the user's implicit consent by IndiaMart SRL and only for the stated purpose of this site. The information provided by the user throughout the use of the site will be used to send the user order confirmations and commercial offers strictly related to the commercial profile of this site, as well as for the purpose of creating a database of customers interested in our products and services, who will receive information about any promotions.

IndiaMart SRL certifies that it will respect the rights conferred by Law no. 677/2001 on the protection of individuals with regard to the processing of personal data and the free movement of such data, Law no. 365/2002 on electronic commerce, as well as Ordinance no. 130/2000 on consumer protection in the conclusion and performance of distance contracts, as amended.
IndiaMart SRL does not request or store any information regarding the customer's bank card(s), as these are processed directly on the servers of the online payment service provider.

How long do we keep your personal data?

We will store your personal data for 1080 days from the last activity in your account. You can ask us to delete certain information or close your account at any time and we will comply with these requests, subject to retaining certain information even after the account is closed, in situations where applicable law or our legitimate interests require it.

The data collected for the purpose of sending newsletters and/or alerts will be used by the company within the limits of the Privacy Policy. The Client may opt out of receiving Newsletters at any time by using the link specifically provided within any Newsletter. Opting out of receiving Newsletters does not imply the waiver of the consent given for this Document.

IndiaMart SRL reserves the right to select the persons to whom it will send newsletters and/or alerts, as well as the right to remove from its database any client who has previously expressed consent to receive newsletters and/or alerts, without any subsequent commitment from the company or any prior notification thereof.

IndiaMart SRL may limit the right of access and purchase of some customers if suspicions of fraud or violation of legal provisions and those mentioned in the terms and conditions arise.

How to order, pay and deliver products

Ordering products and paying for products

The customer will be able to order products on the website https://www.indiamart.ro by adding them to the shopping cart. After adding all the desired products to the cart, the order will be finalized, at the same time choosing the desired payment method ( described in the chapter "Product Payment" ). Once a product has been added to the shopping cart, it is available for purchase to the extent that there is stock available for it.

In the shopping cart, the customer can change the quantity of the desired products or even give up a product, being able to see his products, accompanied by photos, the unit price and the final price. Adding a product to the shopping cart, in the absence of order completion, does not entail the registration of the order, nor the automatic reservation of the product.

After placing the order on the site, confirmation and acceptance of the order is made by electronic mail, to the customer's e-mail address specified in the order form, within the limit of available stock. The conditions under which delivery is made as well as the delivery terms are described in the chapter "Product Delivery ".

If the product is not in stock, IndiaMart SRL will communicate this fact to the customer as soon as possible, either by email or by telephone, at the telephone number registered when placing the order; at the same time, the customer will also be informed of the conditions and time frame in which the product can be delivered.

In accordance with art.8, para.(9) of OUG no. 34/2014 regarding consumer rights in contracts concluded with professionals, as well as for the amendment and completion of certain normative acts, the moment of conclusion of the distance contract is the moment of confirmation by the seller of the acceptance of the order sent by the consumer. An order not confirmed by IndiaMart SRL does not have the value of a contract.

After placing the order, IndiaMart SRL reserves the right to request customers to pay in advance a portion or the entire value of the products ordered through this site, according to criteria based on the value of the order, the type of product, the delivery interval, etc. In this case, the order will be considered accepted only after the advance payment or the entire value of the product has been recorded in the account of IndiaMart SRL . The customer will be informed of this aspect at the time of order confirmation, and/or through the information found on the product details page on the site.

If for certain products, the customer is requested to pay an advance, this will be done by bank transfer, to the account indicated on the proforma invoice. After receiving the advance payment, the customer will receive an advance tax invoice by email.

The unpaid difference in the value of the product after the advance payment will be paid upon delivery of the product. To expedite delivery, the customer is asked to send proof of payment to the email address indiamarteu@gmail.com

The product will be delivered only after confirmation of the receipt of the advance payment into the account of IndiaMart SRL .

Prices on the site are expressed in RON and include VAT, but do not include delivery costs, unless expressly specified on the site.

An order may be canceled for the following reasons:

• In the case of online payment, the non-acceptance of the payment transaction by the issuing bank of the customer's card;

• Also in the case of online payment, non-acceptance of the transaction by the secure card payment processor, agreed by IndiaMart SRL;

• the data provided by the client when registering on the site are incomplete and/or incorrect;

• the order is returned;

• the ordered products are no longer available, and the customer does not want them replaced with similar products

Any modification of the order, after its placement and acceptance, whether it concerns the addition of new products, or the change of billing and/or delivery data, will be communicated in writing via e-mail or by telephone, during working hours. Modification of the order, in the sense of its cancellation, will be done exclusively electronically and will follow the procedure described in the chapter "Conditions of withdrawal".

In the event that a product ordered by the customer and paid for cannot be delivered to him for various reasons, IndiaMart SRL will inform the customer of this fact and will return the product value to the customer's account as soon as possible but no more than 7 (seven) days from the date on which the customer's intention to terminate the contract was recorded in writing and the seller took note of this fact.

Product payment methods

To purchase products from this site, the customer can choose one of the following payment methods, in compliance with the terms and conditions/specifications stipulated in this document:

• Refund, in cash upon receipt of the package from the courier;

• Online by bank card, through the secure online payment service;

Online payments can be made with most bank cards (Visa, Mastercard), using the 3D Secure system, developed by organizations that ensure online transactions the same level of security as those made at an ATM or in the physical environment, at the merchant. This system guarantees that online payments are made in maximum safety conditions, and the website you buy from is also secure.

"3-D Secure" primarily ensures that no information related to the customer's card is transferred or stored on the store's servers or on the payment processor's servers, this data being directly entered into the Visa and MasterCard systems.

3D Secure is a standard adopted by most e-commerce stores.

Product delivery

IndiaMart SRL delivers products door-to-door, through express courier companies, with our main delivery partner Fan Courier.

Orders with a value greater than 200 RON benefit from free delivery; below this amount, the delivery cost is 20 RON VAT included for orders weighing less than kg. The delivery cost for orders exceeding kg is RON VAT included.

Depending on product availability, delivery times may be as follows:

Delivery within 1 - 2 business days, if the product is available in stock.

Delivery within 2 – 3 working days: the product is not in stock and must be brought from the supplier, in the next shipment. The customer will be informed about the estimated delivery time upon acceptance of the order by IndiaMart SRL and will also be notified of the status of the order during its execution as well as of a possible unforeseen event, which could lead to the delay or cancellation of the order.

For the delivery of products that do not have a delivery date specified on the site, the customer can request this date by email or phone, or immediately after placing the order, the customer will be contacted by a representative of IndiaMart SRL and notified of the delivery period. The customer will also be informed of the status of the order during its execution as well as of a possible unforeseen event, which could lead to a delay or cancellation of the order.

IndiaMart SRL will ensure the proper packaging of the products and will ensure the transmission of the necessary accompanying documents.

The product delivery details, including but not limited to the time required for delivery, do not constitute a contractual obligation on the part of IndiaMart SRL without either party being able to claim damages from the other, in the event that either party may be or is prejudiced in any way as a result of their violation.

GUARANTEES

The products sold by IndiaMart SRL benefit from warranty conditions in accordance with the legislation in force (OG 21/1992, Law 449/2003 and OG 174/2008) and the commercial policies of the manufacturers. In the event of a product failure within the warranty period, the buyer must present the defective product accompanied by the fiscal invoice issued by the manufacturer.

According to the provisions of art. 2 point a of Law 449/2003 on the sale of products and the guarantees associated with them and of art. 2 point 2 of OG 21/1992 on consumer protection, these conditions related to guarantees apply only to consumers, individuals or groups of individuals who buy, acquire, use or consume products outside their professional or commercial activity.

Products in at least one of the following situations are not covered by the warranty:

• have been stored or assembled incorrectly, used inappropriately or for other purposes, altered or cleaned by your own methods or with inappropriate substances. The warranty does not cover normal wear and tear of the product, cuts, fire, damage, theft, discoloration of the product or component parts due to exposure to the sun or another strong source of heat or due to contact with water, painting of the product by the customer, damage to the product due to calamities, breakage or scratching of the product due to impact, defects caused by storage in humid conditions, cleaning with inappropriate substances or temperatures other than those specified on the label with the maintenance instructions;

• breaking, scratching and chipping products made of fragile materials;

• use of the product in industrial settings, in public places or for professional purposes, unless otherwise specified;

• intervention, repair or modification of the product (cutting, drilling, painting or gluing other parts).

The warranty conditions aim to repair or replace a product at no additional cost, if a lack of conformity, a manufacturing or material defect is found and if this product has been used normally and under normal conditions, confirmed by technical expertise by a specialized service.

Transfer of ownership of products

The ownership of the product will be transferred upon delivery, after signing the receipt of the transport document provided by the courier and after full payment by the customer. The title of ownership of the product delivered to the customer will be transferred only after receipt of the full amount due, based on these Terms and Conditions, directly or through the agents of IndiaMart SRL.

Withdrawal conditions

According to GEO no. 34/2014 on consumer rights, as well as for the amendment and completion of certain normative acts, the customer may exercise his right to withdraw from a distance contract, within a period of 14 calendar days from the date of receipt of the products, without having to justify the decision to withdraw and without incurring any costs other than the direct costs related to the return of the products, as well as the costs related to the diminution of the value of the products resulting from their handling, other than what is necessary to determine the nature, characteristics and functioning of the products.

The following are exempt from the right of withdrawal:

• the supply of products that, after delivery, have been tampered with, changed or modified from their original form;

• supply of specially ordered products;

• supplying products that are damaged;

The customer who wishes to return a product must notify the representatives of IndiaMart SRL in writing, by using the withdrawal form or by any unequivocal statement, in which the decision to return will be expressed, the product that the customer wishes to return and other detailed information, such as: the date on which the product was delivered, the reason why the customer wishes to return it, if this product is to be replaced with another product, the bank account where the product value is to be refunded.

The customer is requested to send this written notice to indiamarteu@gmail.com before the expiration of the withdrawal period.

Only after processing and approval of this written notice by IndiaMart SRL, will you be able to return the product.

If the customer does not notify us in writing in advance of the desire to return, the return will not be processed. In order to be returned, the product must be in its original packaging intact, with all accessories, with all intact labels and accompanying documents. We reserve the right to decide to accept the return if the above specifications are not respected.

The customer will bear the direct cost of returning the product and is only responsible for the diminution in value of the product resulting from manipulations other than those necessary to determine the nature, qualities and functioning of the product.

The refund of the product value will be made within a maximum of 14 days from the date on which IndiaMart SRL is informed of the decision to withdraw from the contract. The deadline is met if the product is sent back before the expiry of the 14-day period. IndiaMart SRL may postpone the refund of the product value until the product sold is received or until proof is received that it has been shipped. IndiaMart SRL also reserves the right to refuse to accept the return in the event of abuse.
